“MYMAX” PROMOTION

HOW TO ENTER

To be eligible to enter, individuals must either be an existing MYMAX subscriber or become a new subscriber to the MYMAX e-newsletter during the promotional period. To enter, eligible entrants must, during the promotional period, either:

  1. send an SMS to 042 SMS IMAX (042 767 4629) containing their email address. Existing subscribers will receive a promotional email inviting them to update their details. New subscribers will receive a promotional email inviting them to enter. Entrants must click the link in the promotional email to visit the online registration page and either update or enter the requested details and submit the fully completed entry form; or
  2. click through to the online registration page via an online advertising portal, either update or enter the requested details and submit the fully completed entry form.

Individuals can also receive an additional entry for each friend they refer to the competition. To do so, entrants must, once entry is complete, click on the ‘refer a friend’ link and provide the requested details including their friend’s unique email address. Each referred friend will then receive a promotional email from the entrant inviting them to enter. For every referred friend that enters the competition via clicking the link in the promotional email and entering the requested details, the initial entrant will receive one additional entry. Entrants warrant that the individual that they intend to refer the competition to is an Australian resident. Entrants may only refer the competition to a friend’s unique email address once.

SMS entry cost will vary dependent on the mobile network used but will not exceed 55c.

TERMS AND CONDITIONS

  1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. Entry is open to all Australian residents who currently subscribe, or who become subscribers to the MYMAX e-newsletter during the promotional period. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.
  3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process (including but not limited to tampering by way of use of techniques designed to avoid the payment of SMS costs). Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  4. Incomplete, indecipherable or illegible entries will be deemed invalid.
  5. Multiple entries are permitted subject to the following: (a) only one initial entry permitted per person; (b) only one additional entry permitted for each successfully referred friend; and (c) each entry must be submitted in accordance with entry requirements.
  6. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  7. SMS entry cost will vary dependent on the mobile network used but will not exceed 55c. SMS winners will be contacted by email and the Promoter will record their address details so that the prize may be awarded. SMS entries via the Internet are ineligible. Entries are deemed to be received at the time of receipt into the promotion database and NOT at the time of transmission by the entrant.
  8. Promotion commences on 01/10/07. Entries close for each draw on the dates and times specified in the table below. All draws will take place at 3.00pm at Level 5, IMAX Theatre Sydney, 31 Wheat Road, Darling Harbour, NSW 2000 on the dates and times specified in the table below. All times indicated are AEST/AEDST unless specified otherwise. Any entries received after a draw has closed will be placed into the next draw. Winners will be notified by mail and will have their names published in The Australian and on the IMAX Theatre website (www.imax.com.au) on the dates specified in the table below.

  10. The Promoter’s decision is final and no correspondence will be entered into.
  11. The first valid entry drawn in each draw will win exclusive use of the LG Imax Theatre Sydney to a maximum capacity of 500 people for a session of their choice valued at $3,000.

    The use of the LG Imax Theatre Sydney prize is subject to availability and can only be taken within the theatre’s normal trading hours. The prize can be taken Monday to Thursday after 5.00pm, or Saturday and Sunday at 10.00am AEST or 11.00am AEST. The prize can be used for any screening at the theatre although it cannot be used in the opening two weeks of any full-length feature film (full length being any film of 60 minutes or longer duration) and cannot be taken on public holidays. Prize must be taken within 12 weeks from the date the winner is notified.
  12. If the winner of any prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian.
  13. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
  14. The LG Imax Theatre Sydney exclusive use prizes are subject to venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organizers hereby expressly reserve the right to eject any winner (and/or his/her companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
  15. Total prize pool value is $36,000.00. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
  16. A draw for any unclaimed prizes may take place on 02/12/08 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners’ names will be published in The Australian and on the IMAX Theatre website on 05/12/2008.
  17. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  18. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the LG Imax Theatre Sydney exclusive use event is cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) use of a prize.
  19. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
